These terms apply to all contracts between Horoscope Finance and its clients for data analytics and business intelligence services.
Scope includes data analysis & statistics, business intelligence, predictive analytics, data engineering, data quality & governance and consulting. The concrete scope follows from the respective offer.
A contract is formed by order confirmation or by commencement of the service. Offers are non-binding.
Agreed prices apply plus statutory VAT. Invoices are payable within 14 days without deduction.
The client provides the data, access and information required in good time and ensures the lawfulness of the data provided.
Where personal data is processed on behalf, the parties conclude a data processing agreement under Art. 28 GDPR.
After full payment the client receives a simple, unlimited right to use the deliverables (analyses, dashboards, models) for its own purposes.
Analyses and forecasts support decision-making and do not guarantee specific business outcomes. Liability is limited to intent and gross negligence; for slight negligence we are only liable for breach of essential obligations, limited to foreseeable damage.
Both parties treat information provided as confidential and use it solely to perform the contract.
Contracts may be terminated in line with the agreed periods. The right to extraordinary termination for good cause remains unaffected.
We may amend these terms with effect for the future; changes are communicated in good time.
Governing law and place of jurisdiction, where permitted, is Téléphone: +33 1 55 27 44 11. Should individual provisions be invalid, the remainder stays effective.
